My wife's EAD expires on Oct 2 (She has never used her EAD) and she is entering US on Oct 4. Her EAD renewal case is pending. She has a valid H-4 but not stamped. She is planning on entering US on a valid AP. Could there be a problem.

AC21 is a general law and not just applicable to I-485. Extensions beyond 6 years are all part of AC21 law and are based on LC and I-140 also.
So you should be able to transfer ur H1 to new employer. I was laid off too and was able to transfer my H1 using copy of I-140.

Got a better offer, switched jobs.
Will move to Eb2, as i will have 7 years experience...;-) i will save 2 years in Eb dates...
I would suggest make a cange only if you can be sure you will change from Eb3 to Eb2.

If they are forcing onto you, as per me, you can give the AC21 Paper and G-28. After a couple of months sent a new G-28 from the old/current lawyer with whom you want to go. They will not know about it. This is just my opinion but may be wron as well.

From time to time H visa volume were bumped up to 200k but remember the "per country ration" was never bumped up. They could have said that H is just temporary and i'm sure lot of thoughful folks wont have come or planned to settle but they kept the window open (with H as Dual-intent etc...) so they could lick the best talent but then could be thrown away .... I mean i'm not upset (everybody has right to be more intelligent) but it was a clever and dirty whoever crafted the H-story in 1990 ... but we get it eventually :D

They are making the rules tougher and going slow so that applicants get fed up and leave the country, they have nothing to loose, but the applicants loose everything, SS taxes, medicare, kid's future, home, the prime time of your career, you name it.

My question is - when you return with a valid AP, how does IO or anyone know how long you have been out of the country? I don't remember them collecting the I-94 cards too rigorously when you leave - even, if the airline reps collect the I-94, is someone actually entering that data into a system? I have heard of people actually applying for an AP, then leaving the country before it was approved, and having the AP mailed to them so they could then reenter the country (since technically, your application is deemed abandoned when you leave the country before AP is approved, I would have to assume, the IO in this case didn't really know when the person had actually left the country). So, is there really a way currently for the IO to know when you had left the country?

I have approved labor and I 140 in EB3 category. My PD is April 2003. I don't know how long it will take to file I 485. I am thinking to file GC in EB2 category. My employer is also ready to do so. But I don't know whether I am eligible or not. I have 3 years bachelors degree (B.Sc. in computer SC.) and 2 years Masters degree (Masters in Computer Management). I have 10 years of experience in IT. I am in USA since Oct 1999.
I talked to my Attorney today; she told me that you are not eligible because you need to have 4 years bachelors degree + 2 years of masters degree or 3 years bachelors + 3 years masters degree (like MCA degree)
I am asking this question because I just want second opinion.

The most important thing is by law you need to report change in Address within 10 days of move. Not doing that can get you in trouble. So there is no work around on that issues unless you want to keep the house and commute to your work place. The question I have is whether this changes of address is in same city or different city? In case it is in same city it does not matter I have changed 3 addresses since filing my 485 and no queries because of that. But in case you are moving cities (could be states too) then yes it can trigger a query but in case you are in consulting then it should be fine because your company can say that you still have the job and it is part of your job responsiblities to travel.
One thing that worries me is the there is a field for "Employer info" on AR-11. The fact that I switched employers and never filed an AC21 might raise questions since my current employer is different than the sponsoring one. I would assume you haven't gone through employer change yourself?

I think we are doing a fantastic job with this first rally, but at this time we are in the street only a cheap level for a movement. (Only flyers).
- I dont see an editorial in the news papers (Post or times)
- I dont listen about us in the talk shows.
- I dont see a celebrity involved
- I dont see sponsors or big mony supporting us (just our contributions)
- Do the prensidential candidates know about us???
So what momentum are we talking about? why dillute our energy in a second rally if we still have high goals to reach in this one.
I only see very enthusiastic guys trying to grup in a high ideoligical movement, but thats it....
Honestly, I dont want to be in rallies all the time, we are highly skilled immigrants (fancy master degrees!!!!!!!) lets look for the big picture lets go for a sixth grade campaign, lest use our knowledge and high potential..
Innovative new ideas... (high result! !!!)
We thing in flowers campaign, we look sponsors, we look for a air time in the broadcasts. why not get an interview with Lou Dobbs... Lets get into a high level campagin.

I got a copy of my I-140 through FOIA. If you dont have tracking number use your I94 # or your A#. I guess it takes few months. Just apply and forget. No fees.

My Wife's 485 status is same ... Document mailed to applicant. We have never received the document. When we called customer service they said the letter is for finger printing, again the same person said that she sees the finger printing on my wife's file and so can be ignored. Still the status shows the same.

lady at ssn office said her status still shows h4.
she said she will send a request to verify documents to uscis.
i need ssn no asap to apply for licensure to practise.
how can i expediate ssn issue.
what time frame am i looking at
any replies are really appreciated.

On the flip side , I see this as an end to desi consulting. Once everybody uses Ac21 and moves on (And I know most of them stayed until now just for the sake of GC). And there are not enough H1B's to replenish a new batch of people for these companies to continue in their current business model.This will result in a natural death for the business model of holding H1b's.
unless the H1 quota is increased again, without a corresponding increase in GC quotas. In any case there are 65K new H1s coming in every year, a number of whom are going to be working for desi consulting companies. With the current GC queue almost none of those from india, china or EB3-ROW is going to be filing a 485 anytime soon. Some of the H1s who end up full time will get laid off if there is a recession, and the only ones hiring in bad times are the desi consulting companies. These people will get stuck with the consulting companies. So no, they are NOT going away.
